Daddy Lumba estate dispute escalates as Akosua Serwaah appeals High Court ruling

The legal battle over the estate of late highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, has intensified following an appeal filed by Akosua Serwaah at the Court of Appeal in Kumasi.

Ms Serwaah is challenging a decision of the Kumasi High Court which recognised both her and Priscilla Ofori, also known as Odo Broni, as the lawful surviving spouses of the deceased musician.

In her notice of appeal, Ms Serwaah is contesting the entirety of the High Court’s judgment, arguing that the trial court erred when it rejected and declared inadmissible a marriage certificate she presented to support her claim as the sole surviving spouse.

She further contends that the High Court misapplied the law by holding that she failed to meet the requirements of the Evidence Act, 1975 (NRCD 323) for the admission of the marriage certificate into evidence.

The appellant is therefore asking the Court of Appeal to set aside the High Court’s ruling and to declare her as the only lawful surviving spouse of the late musician.

High Court Decision

On November 28, 2025, the Kumasi High Court, presided over by Justice Dr Dorinda Smith Arthur, dismissed Ms Serwaah’s suit in which she sought exclusive recognition as Daddy Lumba’s surviving spouse.

The court held that she failed to prove that her marriage to the deceased was contracted under the Marriage Ordinance in a manner that would exclude other lawful spouses.

According to the judgment, the evidence established that Daddy Lumba married Akosua Serwaah under customary law, which is potentially polygamous. Consequently, the court found that his subsequent marriage to Odo Broni was also valid under Ghanaian law.

In its final ruling, the High Court declared both Akosua Serwaah and Priscilla Ofori (Odo Broni) as the legally recognised surviving spouses of the late music icon.
